GSV Early Access Terms of Service
Effective date: September 30, 2026
These Terms of Service (“Terms”) govern your use of the hosted GSV service, including GSV websites, applications, AI agents, connected-device functionality, integrations, and related services (collectively, the “Service”).
The Service is provided by:
Humans and Machines, Inc.
131 Continental Dr, Suite 305
Newark, Delaware 19713
United States
Email: hello@humansandmachin.es
In these Terms, “GSV,” “Humans and Machines,” “we,” “us,” and “our” refer to Humans and Machines, Inc.
By creating an account, accepting an invitation, or using the Service, you agree to these Terms.
1. What GSV is
GSV is an AI-powered personal computing and automation system.
Depending on the features you use and permissions you grant, GSV can interact with computers, files, applications, websites, browser sessions, communication services, repositories, and other connected systems on your behalf.
GSV uses artificial intelligence. AI-generated outputs may be inaccurate, incomplete, unexpected, or inappropriate for your circumstances, and an AI agent may misunderstand an instruction or take an unintended action.
The hosted Service is separate from GSV's open-source software. Open-source components remain subject to their applicable licenses. These Terms apply to the hosted Service operated by Humans and Machines.
2. Eligibility
You must be at least 18 years old and legally capable of entering into these Terms to use the Early Access Service.
Invitations and login credentials issued to an individual are personal to that individual and may not be sold, shared, or transferred.
3. Early Access
GSV is currently an early access or beta service and is provided free of charge.
Features may be incomplete, experimental, unstable, changed, restricted, or removed. The Service may experience errors, interruptions, unintended behavior, compatibility problems, or loss of functionality.
We may materially change the Service during Early Access and do not guarantee that any particular feature, integration, AI model, interface, or capability will remain available.
You should maintain appropriate independent backups of important data.
No service-level agreement or uptime commitment applies during Early Access unless we expressly agree otherwise in writing.
We may introduce paid plans or usage charges in the future. We will not charge you without first informing you of the applicable pricing and obtaining any agreement required by law.
4. Your account and security
You are responsible for keeping your credentials secure, for activity performed through your account, for maintaining appropriate security on connected devices and accounts, and for notifying us promptly if you believe your account or a connected system has been compromised.
Your username, display name, and other account names must not be offensive, hateful, abusive, threatening, sexually explicit, or misleading, and must not impersonate another person or organization. If we reasonably determine that a name violates this rule, we may ask you to change it or may change or remove it ourselves, including without prior notice where reasonably necessary to address abuse or protect others.
You may not access or attempt to access another person's GSV account, device, data, or connected service without authorization.
5. Account Owners, Spaces, and Space Users
GSV Accounts and Spaces
A GSV account allows you to create, own, and manage one or more GSV Spaces.
The person or organization that creates the GSV account is the “Account Owner.” A “Space” is a GSV environment created or managed through that account. A “Space User” is any other person whom the Account Owner invites, provisions, or otherwise permits to access or use a Space.
By creating a GSV account, you agree to these Terms for your account and for every Space that you create, own, or manage.
If you create a GSV account on behalf of an organization, you represent that you have authority to accept these Terms on that organization's behalf.
Account Owner responsibilities
The Account Owner controls who may access its Spaces and is responsible for administering those Spaces.
The Account Owner is responsible for:
- deciding whom to invite or create accounts for;
- assigning and managing user permissions;
- the instructions, files, content, and other information submitted to its Spaces;
- ensuring that it has the rights and lawful authority necessary to provide that information to GSV;
- providing any notices and obtaining any permissions or consents required for information it provides about other people;
- the use of GSV by Space Users whom it authorizes; and
- removing or restricting access when a Space User should no longer have access.
If an Account Owner creates an account or provides information for another person, the Account Owner represents that it is authorized to do so and is responsible for ensuring that the person's use of the Space complies with these Terms.
Creating an account for another person does not give the Account Owner ownership of that person's personal information or limit any privacy rights that person may have under applicable law.
We may require Space Users to acknowledge our Privacy Policy or accept terms applicable to their own use of GSV before accessing a Space.
Space Data
“Space Data” means content, files, messages, instructions, account information relating to Space Users, connected-service information, and other data submitted to or processed through a Space at the direction of the Account Owner or its Space Users.
As between Humans and Machines and the Account Owner, the Account Owner is responsible for determining whether and for what purposes Space Data is submitted to and processed through GSV.
To the extent Humans and Machines processes personal data contained in Space Data solely on behalf of the Account Owner, Humans and Machines acts as a processor or service provider and processes that information to provide the Service and in accordance with the Account Owner's instructions and applicable data-processing terms. Before using hosted GSV for organization processing of this kind, contact us to agree those terms.
Humans and Machines remains independently responsible for processing for which it determines the purposes and means, including processing necessary for GSV account administration, authentication, security, abuse prevention, service operations and telemetry, legal compliance, and protecting the Service.
Requests concerning Space Data
Account Owners are responsible for managing Space Data and responding to requests from their Space Users where the Account Owner is responsible for that data under applicable law.
Where required, Humans and Machines will provide reasonable assistance with requests concerning Space Data that cannot be completed using GSV's available controls.
6. Permission for GSV to act
A core feature of GSV is its ability to perform actions on your behalf.
Depending on the capabilities and permissions you enable, GSV may be able to:
- read, create, edit, move, or delete files;
- run commands or software on connected computers;
- interact with source-code repositories and development environments;
- navigate websites and use authenticated browser or application sessions;
- read information available through connected services;
- create, edit, upload, download, or submit content;
- send messages and other communications;
- receive and send email;
- interact through supported messaging services;
- schedule or initiate later actions; and
- perform other actions that you specifically enable or request.
When you connect a device, account, integration, browser session, or other system to GSV, you authorize GSV to interact with that system to the extent reasonably necessary to carry out your instructions and provide the Service.
You are responsible for ensuring that you have the right to instruct GSV to access or act on any account, system, device, information, or content involved.
7. AI actions can have consequences
GSV may misunderstand instructions, make incorrect assumptions, provide inaccurate information, or take unintended actions. Actions involving files, messages, repositories, account settings, external services, or other systems may be difficult or impossible to reverse.
You should use appropriate caution for consequential actions, including actions involving important files, financial commitments, production systems, publication of information, communications with other people, deletion or modification of data, account permissions, security settings, or legal or contractual obligations.
Where GSV provides confirmation, approval, or permission controls, you remain responsible for deciding which permissions and actions are appropriate for your use.
8. Your Content
“User Content” means information you provide to or make available through GSV, including prompts, messages, files, instructions, connected-service information, process history, agent state, email, tool results, and other information processed at your direction.
You retain ownership of your User Content.
You grant Humans and Machines a limited right to host, copy, transmit, process, transform, and otherwise use User Content as reasonably necessary to provide, operate, secure, maintain, and improve the Service in accordance with these Terms and our Privacy Policy.
You are responsible for ensuring that you have the rights and permissions necessary to provide User Content to us.
We do not use private GSV conversations, files, or content obtained from connected accounts to train general-purpose AI models.
9. AI inference
GSV uses third-party infrastructure to perform AI inference.
Our hosted managed inference currently uses Cloudflare Workers AI. Information necessary to perform a request may be processed by Cloudflare, including prompts, relevant conversation context, agent state, tool results, files or media needed by the request, and generated output.
We configure our managed AI infrastructure so that prompt and response bodies are not retained in ordinary AI Gateway request logs. Certain operational metadata, such as model information, token usage, request status, cost, and duration, may be retained.
The AI infrastructure and specific underlying models used by GSV may change as the Service develops.
10. Web search
Where GSV's managed web-search feature is enabled, GSV currently uses Exa to perform web searches.
Search queries and related parameters necessary to perform a search may be transmitted to Exa.
We do not currently operate this managed search integration under a zero-data-retention arrangement. Information transmitted to Exa may therefore be retained or otherwise processed in accordance with our agreement with Exa and its applicable privacy practices.
11. Connected and third-party services
GSV may interact with third-party services that you choose to connect, including websites, communication services, developer tools, APIs, and other applications.
Information transmitted to a third-party service at your request is also subject to that service's terms and privacy practices.
We are not responsible for the availability, security, functionality, policies, or actions of third-party services.
You are responsible for complying with the terms applicable to services and accounts you connect to GSV.
12. Communication integrations
GSV may support communication services such as email, Slack, Telegram, or other services.
Connecting these services may require GSV to retain authentication tokens, account or workspace identifiers, pairing information, message-routing information, and other information necessary for the integration to function.
When you instruct GSV to send information through a connected service, you authorize us to transmit that information to the applicable third party.
13. Social and People features
GSV may allow you to interact with people using other GSV Spaces through features such as public profiles, message requests, private invitations, contacts, and conversations.
Public profiles
You may choose to publish a public GSV profile. Information you publish may include your alias, display name, description, contact preferences, and whether messages may be sent by you, your Ship, or both.
Information you publish as part of a public profile is intended to be public and may be accessible outside your Space. Do not include information in a public profile that you want to keep private.
You are responsible for the information you choose to publish and must not impersonate another person or organization or publish information that violates another person's rights.
Messages and contacts
When you send a message, message request, attachment, or other content to another GSV user, that information leaves your Space and is transmitted to the recipient's Space.
The recipient may retain a copy of information you send to them. Removing information from your own Space does not necessarily remove copies that have already been delivered to another person.
You may use available controls to accept or decline message requests, save contacts, mute conversations, or block other users.
You may not use GSV's social features to send spam, harass or threaten others, evade a block or other communication restriction, impersonate others, or send content that is unlawful or violates these Terms.
Messages sent by your Ship
GSV may allow you to authorize your Ship to participate in conversations or contact another person on your behalf.
Messages are designed to indicate whether they were sent by you or by your Ship. You are responsible for the permissions and instructions you give your Ship and for its use of social features on your behalf.
AI systems may misunderstand instructions or communicate something you did not intend. You should use appropriate review and permission controls for consequential communications.
We may restrict use of social features, remove or unpublish public profile information, or suspend accounts where reasonably necessary to enforce these Terms, protect users, or protect the Service.
14. Acceptable use
You may not use GSV to violate applicable law or another person's rights; access accounts, systems, networks, devices, or information without authorization; distribute malware or intentionally compromise systems; steal credentials or confidential information; facilitate fraud or unlawful impersonation; conduct unlawful surveillance; harass, threaten, exploit, or abuse others; infringe intellectual-property or privacy rights; evade security controls without authorization; or operate systems where failure could reasonably cause death or serious physical injury.
You may not assist another person in doing any of the above.
GSV is not designed to replace qualified professional judgment in medical, legal, financial, emergency, or similarly high-consequence settings.
We may investigate suspected abuse and restrict or terminate access where reasonably necessary to protect users, third parties, GSV, or the security and integrity of the Service.
15. Sensitive information
Because GSV may access information available through connected computers and services, it is technically possible for GSV to encounter confidential or sensitive information.
The Early Access Service is not intended for regulated or highly sensitive workloads unless we expressly agree otherwise.
You should exercise particular caution before using Early Access to process medical records, biometric information, government identification information, highly sensitive financial information, information concerning children, classified information, or other specially regulated information.
16. Intellectual property
Except for User Content and open-source components governed by their respective licenses, GSV and its associated software, design, branding, documentation, and hosted Service are owned by Humans and Machines or our licensors.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the hosted Service while your account remains active.
These Terms do not transfer ownership of our intellectual property to you.
17. Feedback
If you voluntarily provide suggestions, ideas, bug reports, or other feedback about GSV, you allow us to use that feedback without restriction or compensation to develop and improve GSV.
This does not give us ownership of unrelated User Content.
18. Privacy
Our collection and processing of personal data are described in the GSV Privacy Policy.
Because GSV can interact with computers, files, accounts, browser sessions, communications, and third-party services, you should review the Privacy Policy before connecting systems containing personal or confidential information.
19. Account closure and data requests
You may stop using GSV at any time.
You may request account closure, access to your information, correction of information, or deletion of applicable personal information by contacting hello@humansandmachin.es.
Deletion may involve multiple systems, service providers, backup or recovery systems, and connected services and therefore may not be instantaneous.
We may retain information where required or permitted by applicable law, including information necessary for security, fraud prevention, dispute resolution, enforcement of these Terms, or compliance with legal obligations.
Our Privacy Policy provides additional information about retention and privacy rights.
20. Suspension and termination
We may restrict, suspend, or terminate access if you materially violate these Terms, your use creates a material security or legal risk, we reasonably believe your account has been compromised, we are legally required to do so, or we discontinue the Early Access program.
Where reasonably possible, we will provide notice before termination unless immediate action is necessary for security, legal, or abuse-prevention reasons.
Provisions that by their nature should survive termination will continue to apply.
21. Disclaimers
GSV is experimental software.
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available.”
We do not guarantee that GSV will always be available; that AI-generated information will be correct; that an AI agent will correctly interpret every instruction; that an agent's actions will produce the intended result; that every action will be reversible; that integrations or third-party services will remain available; that the Service will be free from errors or interruptions; or that data will never be lost.
Nothing in these Terms excludes statutory warranties or consumer rights that cannot legally be excluded.
22. Limitation of liability
Nothing in these Terms limits liability where doing so would be unlawful.
To the fullest extent permitted by law, Humans and Machines will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, revenue, business opportunity, goodwill, or data arising out of or relating to the Service.
If you use the Service for business purposes, the aggregate liability of Humans and Machines arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service during the twelve months preceding the event giving rise to the claim or (b) US $100.
For consumers, these limitations apply only to the extent permitted by mandatory consumer law.
You acknowledge that independent backups and appropriately limited permissions are important safeguards when using software capable of changing files or taking actions on your behalf.
23. Business users
If you use GSV on behalf of a business or organization, that organization is responsible for ensuring that its use complies with applicable laws and that it has authority to provide any personal, confidential, employee, customer, or third-party information processed through GSV.
24. Changes to the Service or these Terms
Because GSV is under active development, we may update the Service and these Terms.
If a change materially affects your rights, we will provide reasonable notice through the Service, by email, or another appropriate method.
The current Terms will state their effective date.
If you do not agree to updated Terms, you should stop using the Service before they take effect.
25. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.
If you are a consumer, this choice of law does not deprive you of mandatory protections provided by the law applicable in your country or state of residence.
Subject to mandatory consumer rights concerning jurisdiction, disputes relating to these Terms or the Service will be subject to the state and federal courts located in Delaware.
26. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer your rights under these Terms without our consent.
We may transfer these Terms in connection with a merger, acquisition, financing, corporate reorganization, or transfer of all or part of the GSV business, subject to applicable law.
